Terms and conditions of sale

These terms and conditions of sale are agreed between, on the one hand, Akline, a limited liability company with capital of €200,000, whose registered office is located at Zone Espace Leaders 65 allée de Champ Galère, 74540, Alby-sur-Chéran, registered in the Annecy Trade and Companies Register under number B 318 659 513, hereinafter referred to as ‘Akline’, and on the other hand, by any natural or legal person wishing to make a purchase via the “Akline” website, hereinafter referred to as ‘the buyer’.

These terms and conditions of sale are intended to define the contractual relationship between Akline and the purchaser and the conditions applicable to any purchase made through the Akline e-commerce site, whether the purchaser is a professional or a consumer.

The purchase of goods through this website implies the buyer’s unconditional acceptance of these terms and conditions of sale, which shall prevail over any other general or specific terms and conditions not expressly approved by Akline.

Akline reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable terms and conditions will be those in force on the date of the buyer’s order.

The products offered are those listed on the Damzy®.com website. These products are available while stocks last. The photographs on the website are as accurate as possible, but cannot guarantee a perfect likeness to the product offered, particularly with regard to colours.

The prices listed in the catalogue are in euros, excluding VAT and including VAT, taking into account the VAT applicable on the day of the order. Akline reserves the right to modify its prices at any time, it being understood, however, that the price listed on the website on the day of the order will be the only one applicable to the buyer. The prices indicated include order processing costs, excluding transport and delivery costs, provided that they take place in the geographical areas specified below.

The buyer who wishes to purchase a product must:

⇒ Complete the online order form, providing all the references for the selected products and correctly filling in all the requested details.
⇒ Confirm your order after checking it.
⇒ Make the secure payment in accordance with the terms and conditions.

Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke one’s own terms and conditions of purchase or other conditions.

All data provided and the recorded confirmation shall constitute proof of the transaction. The confirmation shall constitute signature and acceptance of the transactions carried out. The seller shall send confirmation of the recorded order by email.

Buyers who are non-professional individuals have a seven-day withdrawal period from the date of delivery of their order to return the product to the seller for exchange or refund without penalty, except for return shipping costs. Products must be returned intact, in their original, unopened packaging.

Payment is due upon placing the order. Payments will be made by credit card and will be processed through the secure PayPal system, which uses SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can access it during transmission over the network. The buyer’s account will only be debited when the available products are shipped, and only for the amount of the products shipped, plus shipping costs.

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. The risks are borne by the purchaser from the moment the products leave the seller’s premises. In the event of damage during transport, a reasoned complaint must be made to the carrier within three days of delivery. Delivery times are given for information purposes only. If they exceed thirty days from the date of the order, the sales contract may be terminated and the purchaser reimbursed.

All products supplied by the seller are covered by the legal warranty provided for in Articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned in its original packaging to the seller, who will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made by post to the following address: Zone Espace Leaders 65 allée de Champ Galère, 74540, Alby-sur-Chéran, within thirty days of delivery.

The seller, in the online sales process, is bound only by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, service interruption or other unintentional problems.

All elements of the Akline website are and remain the exclusive intellectual property of the brand. No one is authorised to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, elements of the website, whether software, visual or audio.

Any simple or hypertext link is strictly prohibited without Akline’s written consent.

In accordance with the French Data Protection Act of 6 January 1978, personal information relating to purchasers may be subject to automated processing. AKLINE undertakes not to disclose any information concerning its customers.

Akline shall archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. Akline’s computerised records shall be considered by the parties as proof of communications, orders, payments and transactions between the parties.

These online terms and conditions of sale are subject to French law. In the event of a dispute, jurisdiction is assigned to the courts of Annecy, notwithstanding multiple defendants or the introduction of third parties.

By placing an order, the customer authorises AKLINE or its agent, without any time limitation, to communicate, display, show physically or in images on any visual medium or media, and offer in very limited quantities, DAMZY clips and flyers decorated with the customer’s logo. AKLINE Plastics undertakes not to sell the said clips and flyers or to trade in them by any other means, directly or indirectly, without the customer’s prior written consent. The customer, acting as an intermediary for its own customer, must obtain the authorisation referred to in this provision from the owner of the trademark or its duly authorised representative and provide it to AKLINE Plastics no later than at the time of ordering.
